Do Private Investigators in Texas need Insurance?
The answer is yes. Not just because it is the smart thing to do, but also because it is required by statute. The requirements, codified in Texas Occupations Code section 1702.124, require liability insurance for any applicant for a company license. The insurance policy must contain minimum limits of:
- $100,000 for each occurrence for bodily injury, and property damage;
- $50,000 for each occurrence for personal injury, and
- a total aggregate amount of $200,000 for all occurrences.
These limits may or may not be sufficient for your business. Certainly, as your business grows, your limits should grow with you. At Sunstone Insurance Agency, we take the time to work with our clients and help them determine the best private investigator general liability limits for their business.
It is important to keep in mind, that your insurance provides a duty to defend you against claims covered by the policy. A typical personal injury claim will cost close to or more than $50,000 just to defend. A protracted legal battle will certainly eat up those limits, and there may be nothing left to pay damages. These are all important considerations in choosing the liability limits for your business
Private Investigator Insurance in Texas
At Sunstone, we offer statewide, and in some cases, multi-state options for your private investigation insurance. We are centrally located in Austin and Round Rock, Texas, but we help private investigators place their insurance in the surrounding area as well.
Bodily injury vs. property damages vs. personal injury
The typical general liability policy for private investigators pays for claims of bodily injury (typically bodily harm, sickness, or disease, including resulting death) and property damage to third parties. While these are important coverages, they might not be the area of greatest exposure to your business.
Personal injury is different than bodily injury, yet customers often conflate the two coverage areas. It is a crucial difference that must be understood. Personal Injury includes offenses that produce harm other than bodily injury, including false arrest, detention, or imprisonment; malicious prosecution; wrongful eviction; slander; libel; and invasion of privacy. Now consider that some general liability policies will not automatically cover personal injury.
Considering the coverage provided for under personal injury, would it make sense for a private investigator liability insurance policy to exclude personal injury? At Sunstone Insurance Agency we want our clients to know as much about their private investigator liability insurance as we do. We are happy to audit your current policy or review an existing quote, and we won’t sell you a private investigator liability policy that does not adequately cover your business
